Work Package 2: Legal framework update

WP2 will perform a study on updating the Ukrainian legal framework to comply with key European directives and regulations on EGNSS in transport with the end objective of providing a recommended roadmap for legislative updates in the field of EGNSS applications.

Harmonizing the national laws with EU transport legislation, as well as developing and implementing international regulations and standards is an integral part of Ukrainian Strategy for Transport for the period up to 2020. At the same time, the strategy sets up the action of cooperating in the use of satellite navigation systems within the framework of Co-operation Agreement on a Civil Global Navigation Satellite System (GNSS) between the European Community and its Member-States, and Ukraine.

It is in this perspective, taking into account the overall objective of the Galileo 3 Call, i.e. of “releasing the potential of EGNSS applications through international cooperation”, that UKRAINE will carry out a study on updating the Ukrainian legal framework to key European directives and regulations on EGNSS in transport as WP2 of the project.

The study will be composed of 4 main tasks:
1. Definition of the relevant applications: in order to identify the most relevant EGNSS applications in need of legislative updates, a 2 step process will be followed: an assessment based on secondary sources will be performed first, followed by 15 face-to-face in-depth interviews of selected experts in Ukraine. The assessment will enable the identification of the applications to prioritize in the domains of road, inland waterways, rail, aviation and multimodal logistics and to select those with highest potential for further analysis, based on a preliminary assessment of their market potential and of the likelihood of updating the legal framework.
2. Legal study to analyse the possible legislative actions necessary based on a review of the relevant EU legal basis on EGNSS, a review of the existing Ukrainian legal framework and a gap analysis on the elements required to update the Ukrainian framework so as to comply with EU regulations.
3. Strategy: armed with the results of the legal study, a strategy for updating the legislative framework will be constructed to identify the legislative provisions which must be updated or created ex-novo, assessing which “soft” actions (e.g. awareness measures, support to standardization, etc.) should be developed to facilitate the update of the legislative framework and quantifying the socio-economic impact of the proposed updates through a cost-benefit analysis.
4. Political feasibility and roadmapping - through 10 in-depth interviews, the team will assess the political feasibility of the proposed legislative initiatives taking into consideration the position of key involved political stakeholders as well as possible constraints in terms of privacy, data security, unwillingness to share sensitive information, and operational costs associated with the diffusion of specific EGNSS applications. Based on the feedback collected, the team will define the optimal way forward producing a roadmap for legislative updates in the field of EGNSS applications. While specific to Ukraine, the roadmap is also intended to serve as a basis for other countries.
